… Failure to enforce is tantamount
to a license to infringe … |
Not only are there the traditional defenses based on time delay like the statute of limitations, but even more important, is the view of those in the industry. If you allow the statute of limitations to pass, your claim is lost, but is it any better if you fail to enforce your patent and those in your industry know it? Failure to enforce is tantamount to a license to infringe. And if you have a dozen infringers just where do you begin?
… if you allow others to take your
idea and
do nothing, rest assured,
even more will follow … |
That's where we come in. The Patent Team at Obermayer Rebmann Maxwell & Hippel, LLP knows just what to do. It may be that a warning shot and a quick negotiation is all that is needed. You may be able to accomplish your goals without even filing a lawsuit. But if you allow others to take your idea and do nothing, rest assured, even more will follow. As long as there's profit in an invention, the field will become crowded. Your patent is a legal monopoly. Don't lose its effectiveness by doing nothing. If you do there was never a reason to have gotten it in the first place.
