Getting a Patent:
A patent is a legal, 20-year monopoly on the invention claimed in the patent. Basically, the United States offers this monopoly in exchange for the inventor making public his or her invention, and thus advancing technology. A patent is valuable in that the inventor can exclude all others from making, using, offering for sale, or selling the invention throughout the United States. Thus, the inventor can sell the invention, or license his or her invention and collect a royalty fee.
Patents are granted only for an invention that is new or non-obvious. The invention can be based upon a physical item, or upon a method of performing a business or function. Design patents and biological patents are also possible.
Our team will work with you to protect your invention and ensure that your rights are not lost through delay or inadvertent disclosure of your invention to the public. We will collaborate with you and your company during the patent process, to best understand the full range and opportunity of your invention. Our knowledge of the litigation process and the pitfalls of patent drafting enables us to carefully draft your patent to best maximize its business potential. A well drafted patent is vital to success. It can mean the difference between profiting from your invention or losing your rights altogether. We will ensure your patent is the key to greater opportunity.
Getting a Trademark:
A trademark is not an invention, but rather identifies the source of a product. One may trademark company names, slogans, characters and other identifiers of a product or service. Just like a patent, a trademark owner can exclude those who attempt to copy his or her intellectual property without permission. Our team will thoroughly evaluate your trademark prosecution and business strategy and develop a plan which best suits your business needs. We have extensive experience in handling the IP portfolios of successful enterprises throughout the United States. We offer a broad range of legal services related to trademarks and service marks, including registration, enforcement, and licensing. If necessary, we will litigate trademark infringement actions throughout the United States.
